One of the best ways to prevent a construction defect lawsuit (CDL) is to avoid potential problems.

Here are some important tips that every homeowner should know before remodeling or improving their home:

  • Hire a licensed contractor. State law requires that work over $500 must be performed by a contractor who is licensed by the Contractors State License Board (CSLB). To see if a contractor is licensed and in good-standing:
  • Sign a contract. After ensuring that the contractor is licensed with the CSLB, ask them to sign a contract detailing the work that will be performed. The contract guarantees that a contractor will be held responsible for incomplete or deficient work. Critical tips when preparing a contract:
    • Outline in detail the work to be performed.
    • Include a start date and timetable for completion.
    • If the work changes during construction, update the contract accordingly. This is called a “change order.”
  • If a contractor won’t sign a contract, it’s best to keep looking until you find one who will.
  • Keep a file of all paperwork. Don’t make installment or completion payments ahead of schedule, rather wait until the contractor has made good on the work outlined in the contract.
