bottom line line

There are alternative avenues to resolve construction related issues with your home than entering into a Construction Defect Lawsuit.

Here are some important tips that every homeowner should know:

  • Notify your homebuilder or subcontractor of problems.  Fixing your defects in a timely manner makes good business sense. Also, warranties contractually bind your homebuilder or subcontractor to remedy most problems. Contacting the builder should always be your first recourse.
  • It is best to notify your contractor or homebuilder in writing of any issues that have arisen with the construction of your home.
  • Include your address, housing tract and contact information.
  • List all the problems you are encountering, with as much detail as possible
  • See a sample letter to a homebuilder
  • Find your homebuilder
  • Follow-up with a phone call to ensure they received your letter, note who you spoke with and any response that you may have received.
  • Inform the Consumer Housing Alliance. We want to provide consumers with the information and tools to ensure problems are resolved before litigation. We will help you contact your builder if they are not responsive to your letter. Email us at info@consumerhousingalliance.org.
  • File a formal complaint with the Better Business Bureau. They will work with you and your builder to facilitate communication and to help both sides come to a satisfactory resolution to the complaint.

If your problem still hasn’t been resolved after following the steps above, then you may need to contact a lawyer. Should you need to do so, see our tips on What to Ask Your Lawyer and Your Rights and Responsibilities once you enter into litigation.
