  • Is there a possibility that I won’t receive enough money to cover the costs of repairing my home? What happens if there aren’t enough funds to cover the required repairs?
  • If my neighbor’s home is also involved in the lawsuit, and my home has more defects, will I receive a larger settlement?
  • Will I be able to sell or refinance my home while it is involved in a lawsuit?
  • Who will pay for expert fees, testing costs, and expert witnesses? What is a reasonable estimate or range of those fees and costs?
  • What are the specifics of the lawyer’s fee?
    • How much will the lawyer be paid, and how is that fee calculated?
    • Will a non-monetary remedy require payment of a fee to the lawyer?

Legal Implications

  • When I sell my home, will I be required to disclose:
    • That I was involved in a lawsuit?
    • Whether there was enough money to repair all of the alleged defects?
    • Whether the defects were actually repaired?
  • What happens if I don’t disclose the lawsuit or all of the defects? Can I be sued for fraud?
  • Will the price of my home be affected by the lawsuit?
  • Who determines the defects on my house (often called the statement of damages)? Do I get to decide? What if I disagree with the list of defects or my house doesn’t have all the defects listed? Can I remove any defects from the list before the lawsuit is filed?
  • What alternatives are available to me to remedy the deficiencies before litigation?
  • Will this affect my ability to refinance my home? Will I be obligated to disclose this lawsuit if I wish to refinance my home?
  • Will I be obligated to disclose the alleged claims of defect to my homeowners insurance carrier?
